What Is a Buyer Offer Letter and Can I Include One With My San Diego Offer?

What Is a Buyer Offer Letter?
A buyer offer letter — sometimes called a love letter — is a personal note from the buyer to the seller accompanying the purchase offer. Traditionally used to humanize the buyer and create an emotional connection with the seller, these letters describe why the buyer loves the home and their plans for it — hoping to tip the scales in their favor beyond price and terms alone.
The Fair Housing Concern With Offer Letters
California's Fair Housing Law prohibits discrimination in real estate transactions based on race, color, religion, sex, sexual orientation, marital status, national origin, and other protected characteristics. Buyer offer letters can inadvertently reveal protected class information — a family photo, a mention of religious affiliation, or nationality — and create liability for sellers and their agents who make decisions based on this information.
What California Law and NAR Guidance Say
The National Association of REALTORS and California Association of REALTORS have both issued guidance recommending that listing agents decline to present buyer personal letters to sellers — to avoid fair housing violations. Many San Diego listing agents now have written policies stating they will not present personal letters with offers. This is a legally protective practice, not a rejection of buyers as people.
What Buyers Can Include Instead
- A strong, clean offer with excellent terms and financing — the most effective communication of buyer seriousness
- A cover page with your pre-approval and agent credentials — professional and appropriate
- A brief, factual statement about your intended occupancy or timeline — non-discriminatory
- A direct phone call from your agent to the listing agent — relationship-based communication that does not create fair housing risk
Focus on What Actually Wins
In Rieder Homes Group's experience, San Diego sellers are primarily motivated by price, terms, and certainty of close — not personal stories. The most effective approach to winning a competitive offer is an aggressive, well-structured offer backed by strong financing and prepared by an experienced buyer's agent who has a relationship with the listing agent.
